Preamble

These General Terms and Conditions of Sale ("Terms of Sale" or "CGV") govern the sale of all Pierre Hardy products offered on pierrehardy.com (the "Website") to consumers established in the European Union. The Website is operated by Galerie de l'Assemblée SARL (trading as Pierre Hardy), a subsidiary of Maison Pierre Hardy SAS, a Limited Liability Company with share capital of €918,600, headquartered at 15/17 rue de Valois — Jardin du Palais Royal, 75001 Paris, France, registered with the Paris Trade and Companies Register under number 662 006 030, SIRET 66200603000024, VAT FR41662006030 (hereinafter "Pierre Hardy", "we", "us" or "our").

Customers outside the European Union should visit us.pierrehardy.com. Customers in Japan are served by our local distributor.

These Terms of Sale apply exclusively to consumers within the meaning of the French Consumer Code and the EU Consumer Rights Directive 2011/83/EU. Any business-to-business sale is excluded from these Terms.

By placing an order, the customer expressly acknowledges having read, understood and accepted these Terms of Sale in their entirety. The version applicable is the one in force on the date the order is placed.

Article 1 — Definitions

For the purposes of these Terms of Sale:

  • "Customer" means any natural person, acting as a consumer within the meaning of the French Consumer Code, who places an order on the Website.
  • "Order" means any purchase request validated by the Customer on the Website.
  • "Products" means all items offered for sale by Pierre Hardy on the Website.
  • "Website" means pierrehardy.com, including all related sub-domains.
  • "Parties" means jointly Pierre Hardy and the Customer.

Article 2 — Scope

These Terms of Sale apply to all sales of Products concluded on the Website between Pierre Hardy and Customers established in the European Union.

The Terms of Sale prevail over any other document, including any general terms of purchase of the Customer. They are made available to the Customer in a clear and comprehensible manner before any Order is placed.

By validating their Order, the Customer expressly accepts these Terms of Sale, which constitute a binding contract between the Parties.

Article 3 — Products

3.1. The Products offered for sale on the Website are described and presented as accurately as possible. Photographs and descriptions are not contractual; minor variations in colour, texture or appearance may occur depending on the device or screen used by the Customer.

3.2. Products are offered within the limits of available stock. In the event that a Product is unavailable after an Order has been validated, Pierre Hardy will inform the Customer by email as soon as possible and proceed with the refund of the corresponding amount within 14 days, in accordance with Article L.216-1 of the French Consumer Code.

3.3. Pierre Hardy reserves the right to modify the assortment of Products and to discontinue any Product at any time, without prejudice to Orders already validated.

Article 4 — Prices

4.1. Prices are displayed in euros (EUR), inclusive of all taxes (VAT), applicable on the date the Order is placed.

4.2. Prices include VAT at the rate of the country of delivery within the European Union. No additional duties or customs charges apply to intra-EU shipments.

4.3. Standard shipping is complimentary on all Orders delivered within the European Union, with no minimum purchase required.

4.4. Pierre Hardy reserves the right to modify the prices of the Products at any time, it being understood that the price applicable to an Order is the price displayed on the Website on the date the Order is validated.

Article 5 — Ordering process

5.1. To place an Order, the Customer follows the steps presented on the Website:

  • Selection of Products and addition to the shopping cart;
  • Validation of the shopping cart content;
  • Identification (creation of an account or guest checkout);
  • Communication of mandatory information (name, delivery address, postcode, country, telephone number);
  • Review of the order summary, including the total price (taxes included) and delivery details;
  • Acceptance of these Terms of Sale by ticking the dedicated checkbox;
  • Selection of the payment method and validation of payment;
  • Receipt of an Order confirmation email.

5.2. The Order is deemed formed upon receipt by the Customer of the Order confirmation email sent by Pierre Hardy. The confirmation email constitutes acceptance of the Order by Pierre Hardy.

5.3. Pierre Hardy reserves the right to refuse or cancel any Order:

  • Containing manifestly fraudulent elements;
  • Placed in connection with a previous unresolved payment dispute;
  • Containing incomplete or incorrect information;
  • Where the delivery address is a postal box, a Cedex address, a hotel, or a freight forwarding address;
  • For which the payment is refused or considered suspicious by our payment service providers.

Article 6 — Payment

6.1. Payment is due in full at the time the Order is placed. Accepted payment methods are displayed at checkout and may include credit and debit cards (Visa, Mastercard, American Express), PayPal, and other local payment methods.

6.2. Payment transactions are processed by secure third-party payment service providers. Pierre Hardy does not store full payment card details.

6.3. In the event of a payment refusal or fraud suspicion, Pierre Hardy reserves the right to cancel the Order without notice.

6.4. The Order will be processed only after full receipt of the payment.

Article 7 — Delivery

7.1. Products are delivered to the delivery address indicated by the Customer at the time of the Order, within the European Union exclusively.

7.2. Delivery times are indicative and calculated in business days from the date of dispatch:

  • France: 1 to 2 business days
  • Benelux, Germany: 2 to 3 business days
  • Other EU member states: 3 to 5 business days

7.3. In accordance with Article L.216-2 of the French Consumer Code, Pierre Hardy undertakes to deliver Products within thirty (30) days of validation of the Order at the latest. If this deadline is not met, the Customer may notify Pierre Hardy by registered letter with acknowledgement of receipt to deliver within a reasonable additional period; failing delivery within this additional period, the Customer may cancel the Order and obtain a refund within 14 days.

7.4. Risk of loss or damage passes to the Customer upon physical delivery of the Products.

7.5. In the event of a delivery anomaly (damaged packaging, incorrect or missing items), the Customer must report it to Customer Service within 3 business days at estore@pierrehardy.com with photographs and the Order number.

Article 8 — Right of withdrawal

8.1. In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Customer has a period of fourteen (14) days from the day on which they (or a third party designated by them, other than the carrier) take physical possession of the Products to exercise their right of withdrawal, without giving any reason and without incurring any costs other than those set out in Articles L.221-23 to L.221-25 of the French Consumer Code.

8.2. For Orders containing several items delivered separately, the 14-day period runs from the day the Customer takes physical possession of the last item.

8.3. To exercise the right of withdrawal, the Customer must notify Pierre Hardy of their decision to withdraw by means of an unambiguous statement, for example:

8.4. The right of withdrawal does not apply to:

  • Personalized or custom-made Products (Article L.221-28 3° of the French Consumer Code);
  • Earrings, for hygiene reasons (Article L.221-28 5° of the French Consumer Code);
  • Items marked as final sale, where applicable.

Article 9 — Returns and refunds

9.1. In the event of exercise of the right of withdrawal, the Customer must return the Products to Pierre Hardy without undue delay and in any event within fourteen (14) days from the date of notification of their decision to withdraw.

9.2. Return shipping is complimentary using the prepaid label provided through the Baback returns portal.

9.3. Returned Products must be:

  • Unworn, unused and in their original condition;
  • Returned with all original packaging, including the dust bag, branded box, and any accessories;
  • Free of any signs of wear, damage, or alteration.

The Customer is only liable for any diminished value of the Products resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the Products.

9.4. Pierre Hardy will reimburse all payments received from the Customer, including the cost of standard delivery (where applicable), without undue delay and in any event no later than fourteen (14) days from the day on which Pierre Hardy is informed of the Customer's decision to withdraw, in accordance with Article L.221-24 of the French Consumer Code.

9.5. Pierre Hardy may withhold reimbursement until the Products have been received back or until the Customer has supplied evidence of having sent the Products back, whichever is the earliest.

9.6. Refunds are processed to the original payment method used for the purchase. No cash refunds will be issued.

9.7. We do not process direct exchanges. To purchase a different size, colour, or model, the Customer is invited to return the original item for a refund and place a new Order.

Article 10 — Legal guarantees

10.1. The Customer benefits from the legal guarantee of conformity provided for in Articles L.217-3 et seq. of the French Consumer Code, and from the legal guarantee against hidden defects provided for in Articles 1641 et seq. of the French Civil Code.

10.2. Legal guarantee of conformity (Articles L.217-3 to L.217-17 of the French Consumer Code):

  • The Customer has a period of two (2) years from the delivery of the Product to act;
  • The Customer may choose between repair or replacement of the Product, subject to the cost conditions provided for in Article L.217-12 of the French Consumer Code;
  • The Customer is exempt from providing proof of the existence of the lack of conformity of the Product during the twenty-four (24) months following its delivery;
  • The legal guarantee of conformity applies independently of any commercial guarantee that may apply.

10.3. Legal guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code):

  • The Customer may decide to claim under this guarantee against hidden defects of the item sold within the meaning of Article 1641 of the French Civil Code;
  • In this case, the Customer may choose between cancellation of the sale or a reduction in the sale price, in accordance with Article 1644 of the French Civil Code.

10.4. To exercise these guarantees, the Customer must contact Customer Service at estore@pierrehardy.com with their Order number, photographs, and a description of the defect. Pierre Hardy will inform the Customer of the procedure to follow.

Article 11 — Reservation of ownership

Pierre Hardy retains full ownership of the Products sold until full receipt of the price (principal and any costs).

Customer Service will respond to written complaints within five (5) business days of receipt.

In accordance with Article L.616-1 of the French Consumer Code and Article 14 of EU Regulation 524/2013, in the event of an unresolved dispute, the Customer may refer the matter to the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

Article 13 — Consumer mediation

In accordance with the provisions of the French Consumer Code regarding the "consumer dispute mediation process" (Articles L.616-1 and R.616-1), and following a prior written complaint addressed to our Customer Service that has remained unanswered or whose response has not been satisfactory, the Customer has the right to use, free of charge, the consumer mediation service offered by Galerie de l'Assemblée SARL (trading as Pierre Hardy).

The consumer mediator referenced for our business is CM2C (Centre de la Médiation de la Consommation de Conciliateurs de Justice), referenced by the Commission d'Évaluation et de Contrôle de la Médiation de la Consommation (CECMC).

The Customer remains free to accept or refuse the recourse to mediation, and to follow or not the solution proposed by the mediator. The mediation procedure is free for the Customer.

Article 14 — Personal data

The personal data collected in the context of an Order is processed in accordance with our Privacy Policy, which describes in detail the categories of data collected, the purposes of processing, the legal bases, the retention periods, the recipients of the data, and the Customer's rights under the EU General Data Protection Regulation (GDPR) and the French Data Protection Act.

Article 15 — Intellectual property

All elements of the Website and of the Products, including but not limited to trademarks, designs, models, photographs, images, texts, and graphics, are the exclusive property of Maison Pierre Hardy SAS or its licensors, and are protected by French, European, and international intellectual property laws.

Any reproduction, representation, modification, publication or adaptation, in whole or in part, of these elements, by any means and on any medium whatsoever, is prohibited without the prior written authorisation of Maison Pierre Hardy SAS, and constitutes an act of counterfeiting punishable under Articles L.335-2 et seq. of the French Intellectual Property Code.

Article 16 — Force majeure

Neither Party shall be held liable for any failure to perform its obligations where such failure results from a case of force majeure as defined in Article 1218 of the French Civil Code, including but not limited to acts of God, natural disasters, war, terrorism, strikes, epidemics, governmental actions, or interruptions of telecommunications or internet services.

Article 17 — Applicable law and jurisdiction

These Terms of Sale are governed by French law.

In the event of a dispute between the Parties relating to the formation, performance or interpretation of these Terms of Sale, the Parties will seek an amicable settlement before any legal action.

Failing an amicable settlement, the dispute shall be subject to the competent French courts, in accordance with the rules of common law. The Customer is reminded that pursuant to Article R.631-3 of the French Consumer Code, they may choose, at their discretion, in addition to one of the courts having territorial jurisdiction under the French Code of Civil Procedure, the court of the place where they lived at the time of the conclusion of the contract or of the occurrence of the harmful event.

Mandatory consumer protection laws of the Customer's country of residence within the European Union remain applicable.
